Our Commercial Management Office is seeking a Manager, Contract Administration to lead the contract management and life-cycle maintenance for major projects undertaken by the Operations vendors. Also provides direction to Senior Contract Administrators to facilitate contractual compliance activities, and manage contract change requests and amendments.

What will I be doing?

  • Assists in the development and implementation of Operations’ contract management systems, standards and operational procedures to ensure successful delivery of the organization’s large and complex operational initiatives.
  • Monitors contract performance management through pro-active issue resolution, change requests/amendments, and standardized internal processes that contribute to achievement of desired service levels and Key Performance Indicators (KPIs).
  • Produces contract performance reports and maintains monthly, quarterly and executive management reports and distributes as needed.
  • Authors and assists in the review and analysis of the Division’s highly complex tenders and contract documents to ensure that the appropriate contracting strategy and contractual clauses are applied to reduce risk and protect the interests of Metrolinx.
  • Provides input into complex contractual claims and may lead the management, analysis (e.g. change orders, errors and omissions, negligence evaluation) and resolution of disputes including advising senior management on strategies and negotiating with vendors on behalf of the Division. Interacts with senior staff from internal and external stakeholders with respect to claims, dispute resolution, etc. including Procurement, Legal, external claims and legal consultants, contractors, consultants, Ministry of Transportation, Ontario (MTO) and rail agencies (CN, CP).
  • Authors, oversees and monitors all Divisional contract portfolio groups to ensure risk mitigation and management, value management and cost control to identify and advise on the resolution of a range of critical issues including contractor performance. Ensures contractor adherence to terms and enforces contractual obligations and conditions by engaging internal and external legal representation and leading them in negotiations and resolution of matters, or enforcement of penalty clauses, Liquidated Damages, etc.
  • Identifies, analyzes and develops responses to commercial risks, and reports on contract performance and contingency utilization.
  • Develops risk mitigation strategies to ensure the compliance of contracts and change orders with Metrolinx policies and procedures and to minimize corporate liability throughout the lifecycle of projects. Identifies and closely monitors risks, constraints and contingencies associated with contracts to avoid or mitigate additional costs, penalties and delays. Recommends, implements and continuously adjusts mitigation as well as implementation tactics throughout the lifecycle of projects.
  • Manages the provision of contract administration consultative advice, expertise and support to project teams throughout the life of operations projects.
  • Systematically manages contract-related correspondence, documentation and ensures tracking of contract deliverables is proactively managed.

  • Works with Finance to establish and maintain financial control systems and ensures timely flow of documents required by the Contract Administration and Finance teams.
  • Directly manages Contract Administration department employees in a single work group performing related tasks and manages additional consulting resources as required to support the integrated team.

Qualifications

  • Completion of a degree in, Business Administration, Engineering, Contract/Construction Law, or a related discipline or a combination of education, training and experience deemed equivalent.
  • Minimum eight (8) years’ experience managing the administration of large multi-billion dollar contractual agreements and teams, ideally for an owner/public sector agency involving large-scale infrastructure projects.
  • Expert knowledge of contract administration and claims management techniques and practices in a large multi project complex operational, construction and infrastructure environments.
  • Experience with various procurement methods, both traditional and non-traditional (especially AFP – Alternate Financing Procurement).
  • Skilled in the development and communication of internal contract administration policies, procedures and best practices, preferably in the transit and/or infrastructure industries.
  • Extensive experience in the interpretation of contract law, and Ontario legislation (e.g. Construction Act, Professional Engineers Act, Canadian Construction Documents Committee documents, bespoke contract documents, specifications and drawings, and legal statues and proceedings).
  • Proficient experience in using contract administration systems, such as Primavera Contract Manager and Oracle Unifier.
  • Management and leadership skills to manage departmental staff and lead projects and motivate a team of Senior Contract Administrators, matrixed staff and consultants.
  • Influencing skills to convince senior management, colleagues, clients and vendors of the need to adhere to contract administration control processes.
  • Negotiation and oral/written/presentation skills to represent the Operations Division in dealing with all contract administration issues and to lead claims negotiations with vendors.
