Job description: Under the supervision of the Director, Commercial Management, the Senior Program Manager leads and provides oversight of commercial governance and decision-making for Operations, including coordination across the corporation; provides commercial options and strategic advice to the Director, Commercial Management, VP-Commercial Management, and other Metrolinx partners and leaders.
Key Responsibilities:
- Manages the development and implementation of comprehensive strategies, methodologies, tools and techniques for commercial management excellence and continuous improvement including, the validation of Metrolinx project requirements (including feasibility studies and cost analyses, as required), and recommends commercial strategies consistent with overall strategic goals of the division
- Develops and manages quality assurance systems for the identification of risks associated with contractual obligations; evaluates and recommends changes to mitigation controls to improve management of risks and liabilities
- Manages and monitors benchmarks and metrics, and establishes a reporting functionality to appropriately gauge the alignment of business unit initiatives with corporate direction, strategy, and value for money principles
- Provides expertise in contractual interpretation and provides guidance to staff in the management of change orders, timing, notifications, and dealing with disagreements. Monitors contract amendments to ensure they are issued in writing, and that negotiation and discussions are recorded
- Manages complex contractual claims and leads the management, analysis (e.g. change orders, errors and omissions, negligence evaluation) and resolution of disputes with operational contracts/agreements, including advising Metrolinx Senior Management on strategies and negotiating with vendors and partners on behalf of the division; interacts with senior staff from internal and external stakeholders with respect to claims, dispute resolution, etc., including Procurement, Legal, external claims, and legal consultants, operations, vendors, partners, consultants, regional transportation agencies (TTC, etc.), municipalities, Ontario Ministry of Transportation (MTO), Transportation Canada, and the Canadian Transportation Agency (CTA)
- Oversees third party contractors; represents Metrolinx in the resolution of disputes/claims with vendors, arising from project or service undertakings (e.g. contractual dispute settlements, pre-litigation undertakings, “out-of-court” settlements, and legal proceedings conducted by the appropriate judicial court system)
- Reviews all core operations, business processes, and activities to achieve operational/marketing commercial management excellence; directs the development and implementation of best practices and lessons learned from internal sources and extensive personal professional experience gained through management of major multi-billion dollar infrastructure/transit programs and teams. Monitors performance through the development and tracking of administrative and financial metrics
- Oversees and monitors progress of contracts to ensure that planning objectives are delivered on time and within budget, and that anticipated business results are achieved; monitors off-plan overages and exceptions
- Ensures the procurement of contracts, goods and services that provide the organization with best value, in adherence with corporate commercial operational plan goals and objectives; evaluates tenders and recommends contract awards to management for approval; reviews and recommends to SMT any contract changes, in accordance with corporate signing authority
- Provides strategic leadership and directly manages 3 – 5 professional staff, and indirectly manages more than 15 employees in a single work group or team performing related tasks; empowers management direct reports to achieve performance objectives and manage teams
Must Haves:
- Minimum 10 years of experience in progressively responsible marketing or business roles, related to commercial management in IT
- Experience facilitating third party partnerships with outsourced service providers with minimum of 5 years of experience managing large, complex, multi-year transit or transformation projects and/or operational contracts
- Demonstrated experience with vendor management and contract negotiation to evaluate project tenders and review consultant proposals; sound understanding of contracting principles, practices, rules, regulations and procedures
- Proven knowledge of project management principles and practices
- Knowledge of Contract Law, contracts documents, specifications and drawings, and legal statutes and proceedings
